Terms of Service
These Terms of Service ("Terms") govern your access to and use of Crumb, our AI phone-receptionist service for small businesses, and the website crumb.appsbakery.net (the "Site," and together with Crumb, the "Services"), provided by Apps Bakery ("Apps Bakery," "we," "us," or "our").
Please read these Terms carefully. They are a legal agreement between you and Apps Bakery. Our Privacy Policy explains how we handle personal information and is incorporated into these Terms by reference.
1 Agreement to these terms
By accessing or using the Services, submitting your details through our forms, or clicking to accept these Terms, you agree to be bound by them. If you are using the Services on behalf of a business or other organization, you represent that you have authority to bind that organization, and "you" refers to that organization.
If you do not agree to these Terms, do not use the Services.
2 Who we are
Apps Bakery operates Crumb, an AI assistant that answers phone calls on behalf of small businesses, speaks with their callers, books meetings, and sends call summaries. You can reach us using the contact details at the end of these Terms.
3 The Crumb service
Crumb answers inbound calls to a phone number you connect, converses with your callers using artificial intelligence, can schedule appointments, and sends you summaries of calls. Specific features depend on the plan you select and the configuration you choose.
We may add, change, or remove features over time. We aim to provide reliable service but do not guarantee that the Services will be uninterrupted, error-free, or that every call will be handled exactly as intended.
4 Eligibility & accounts
You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for the information you provide, for keeping any account credentials secure, and for all activity that occurs under your account.
You agree to provide accurate, current, and complete information and to keep it up to date.
5 Free trial & plans
We may offer a free trial so you can evaluate the Services. Unless stated otherwise at sign-up, no credit card is required to start a trial, and the trial runs for the period we specify. We may modify or discontinue trials at any time.
Paid plans, their features, and limits are described at the point of purchase. We may change plan offerings on a going-forward basis.
6 Fees & billing
- Fees. If you subscribe to a paid plan, you agree to pay the fees described at purchase. Unless stated otherwise, fees are billed in advance and are non-refundable except where required by law.
- Renewals. Subscriptions renew automatically for the same term until cancelled. You can cancel at any time before the next renewal to avoid further charges.
- Taxes. Fees are exclusive of taxes, which you are responsible for where applicable.
- Changes. We may change our fees on a going-forward basis with reasonable notice.
7 Acceptable use
You agree not to use the Services to:
- Violate any law, regulation, or third-party right, including telemarketing, call-recording, and consumer-protection laws.
- Send unlawful, deceptive, harassing, or unsolicited communications, or content that is fraudulent or infringing.
- Attempt to gain unauthorized access to, disrupt, reverse engineer, or interfere with the Services or their security.
- Use the Services to build a competing product, or resell them without our written permission.
We may suspend or limit the Services if we reasonably believe they are being used in violation of these Terms or in a way that risks harm to others or to our systems.
8 Call handling & consent
Call-recording and one- or two-party consent laws vary by jurisdiction. If you use Crumb to answer or record calls, you are responsible for providing any legally required notice to, and obtaining any legally required consent from, your callers. We provide configuration options and notices to help you meet these obligations, but compliance for your calls is your responsibility.
9 Messaging & communications
By providing your contact details through our forms or chat, you agree that we may contact you about your request and the Services. Where we send messages on your behalf or you send messages through the Services, you are responsible for obtaining the consents required by applicable law and the policies of telecom carriers and messaging providers, and for honoring opt-out requests.
10 Your content & responsibilities
You retain ownership of the data and content you and your callers provide through the Services ("Customer Data"). You grant us a limited licence to process Customer Data as needed to provide and improve the Services and as described in our Privacy Policy.
You are responsible for the accuracy and legality of Customer Data and for having the rights and permissions necessary for us to process it on your behalf.
11 Intellectual property
The Services, including the Site, software, models, and all related intellectual property, are owned by Apps Bakery or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Services in accordance with these Terms. All rights not expressly granted are reserved.
12 Third-party services
The Services may rely on or link to third-party services (for example, telephony, messaging, scheduling, or analytics providers). Your use of those services may be subject to their own terms, and we are not responsible for them. We do not endorse and are not liable for third-party content or services.
13 Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that AI-generated responses will always be accurate or appropriate. You are responsible for reviewing call outcomes that matter to your business.
14 Limitation of liability
To the maximum extent permitted by law, Apps Bakery and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the twelve (12) months before the event giving rise to the claim, or USD 100 if you have paid nothing.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
15 Indemnification
You agree to indemnify and hold harmless Apps Bakery and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Services, your Customer Data, or your violation of these Terms or applicable law, including call-recording, consent, and messaging laws.
16 Termination
You may stop using the Services and cancel any subscription at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if continuing to provide the Services is no longer commercially reasonable. On termination, your right to use the Services ends. Sections that by their nature should survive termination (such as fees owed, disclaimers, limitation of liability, and indemnification) will survive.
17 Changes to these terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. If we make material changes, we will provide additional notice as appropriate. Your continued use of the Services after an update means you accept the revised Terms.
18 Governing law
These Terms are governed by the laws applicable at Apps Bakery's principal place of business, without regard to conflict-of-laws rules. The courts located there will have jurisdiction over any dispute, except where applicable law gives you the right to bring a claim elsewhere.
